If you are a customer of the Site, NOAH WATCHES SRL will process your personal data, such as your first and last name, phone number, email address, billing address, delivery address, data relating to how you use the Site, for example, your behavior/preferences/habits within NOAH WATCHES SRL, as well as any other categories of data you provide directly in the context of creating a user account, placing an order through the website, or in any other way resulting from using the Site. If you choose to create a user account only before finalizing the order of a product available on the Site, your email address will be requested, based on which an account will be automatically created. If you do not complete the order, your email address and the other data provided will not be stored by NOAH WATCHES SRL, and the created account will be automatically deleted.

2. If you are a visitor to the Site, NOAH WATCHES SRL will process your personal data that you provide directly in the context of using the Site, such as the data you provide in the contact / questions / complaints section, insofar as you contact us in this manner.

III. PURPOSES AND LEGAL BASES OF DATA PROCESSING

1. If you are a customer of the Site, NOAH WATCHES SRL processes your personal data as follows:

• to carry out the contractual relationship between you and NOAH WATCHES SRL, respectively, to receive, validate, ship, and invoice the order placed on the Site, to inform you about the status of the order, to organize the return of ordered products, etc.
  Legal basis: The processing of your data for this purpose is based on the contract concluded between you and NOAH WATCHES SRL, defined within the Terms and Conditions. The provision of your personal data is necessary for the performance of this contract. Refusal to provide the data may result in the impossibility of carrying out the contractual relationship between you and NOAH WATCHES SRL.

IV. DURATION OF DATA PROCESSING

As a principle, NOAH WATCHES SRL will process your personal data only as long as necessary to achieve the processing purposes mentioned above. If you are a customer, we will process your data throughout the entire duration of the contractual relationship and subsequently in accordance with the legal obligations incumbent on NOAH WATCHES SRL (e.g., in the case of financial and accounting supporting documents for which the retention period provided by law is 10 years from the date of the conclusion of the financial year in which they were prepared).

If you withdraw your consent for data processing for marketing purposes, NOAH WATCHES SRL will cease the processing of your personal data for this purpose, without affecting the processing carried out by NOAH WATCHES SRL based on the consent expressed by you before the withdrawal.

V. DISCLOSURE OF PERSONAL DATA

To fulfill the processing purposes, NOAH WATCHES SRL may disclose your data to partners, to third parties or entities that support NOAH WATCHES SRL in carrying out its activity through the Site (for example, courier companies, IT service providers), or to central/local public authorities, in the following cases, listed exemplarily:

• the right to be informed, respectively, the right to receive details regarding the processing activities carried out by NOAH WATCHES SRL, as described in this document;
• the right of access to data, respectively, the right to obtain confirmation from NOAH WATCHES SRL regarding the processing of personal data, as well as details regarding the processing activities, including the manner in which the data is processed, the purpose for which the processing is carried out, the recipients or categories of recipients of the data, etc.;
• the right to rectification, respectively, the right to obtain the correction, without unjustified delays, by NOAH WATCHES SRL of inaccurate personal data, as well as the completion of incomplete data. The rectification/completion will be communicated to each recipient to whom the data was transmitted, except where this proves impossible or requires disproportionate efforts;
• the right to data erasure, without unjustified delays ("the right to be forgotten"), in the event that one of the following reasons applies: they are no longer necessary for the fulfillment of the purposes for which they were collected or processed; the consent is withdrawn and there is no other legal basis for processing; the data subject objects to the processing and there are no legitimate reasons that prevail; the personal data has been processed unlawfully; the personal data must be erased to comply with a legal obligation; the personal data has been collected in connection with the provision of information society services under Union law or the domestic law under whose jurisdiction the controller is located. It is possible that, following a request for data erasure, NOAH WATCHES SRL anonymizes this data (thus removing its personal character) and continues the processing for statistical purposes under these conditions.
• the right to restriction of processing to the extent that: the data subject contests the accuracy of the data, for a period that allows us to verify the correctness of the data; the processing is unlawful, and the data subject objects to the erasure of personal data, requesting instead the restriction of its use; the controller no longer needs the personal data for the purpose of processing, but the data subject requests it to establish, exercise, or defend a right in court; the data subject has objected to the processing (other than direct marketing), for the period of time during which it is verified whether the legitimate rights of the controller prevail over those of the data subject;
• the right to data portability, respectively, the right to receive personal data in a structured, commonly used, and easily readable format, as well as the right for this data to be transmitted by NOAH WATCHES SRL to another data controller, insofar as the conditions provided by law are met;
• the right to object, which can be exercised by submitting a request: at any time, for reasons related to the particular situation in which the data subject is, that the data concerning them be processed based on the legitimate interest of NOAH WATCHES SRL or based on public interest, except in cases where NOAH WATCHES SRL can demonstrate that it has legitimate and compelling reasons that justify the processing and prevail over the interests, rights, and freedoms of the data subjects, or that the purpose is the establishment, exercise, or defense of a right in court; at any time, free of charge and without any justification, that the data concerning them not be processed for direct marketing purposes;
• the right not to be subject to an automated individual decision, respectively, the right not to be the subject of a decision taken solely on the basis of automated processing activities, including profiling, which produces legal effects concerning the data subject or affects them similarly to a significant extent;
• the right to address the National Supervisory Authority for Personal Data Processing or the competent courts, insofar as you consider it necessary.

VII. SUPPLIERS, ADS, AND COOKIES

For the store to work, we use a few suppliers. They only receive the data they need for their service:

• Shopify: the platform on which the website and store run. Orders, customer accounts, and the emails we send you are hosted by Shopify.
• NETOPIA Payments: processes card payments. NOAH does not see or store your card data.
• DPD and FAN Courier: receive your name, address, and phone number to deliver the package.
• Meta (Facebook and Instagram): on the website, we use Meta Pixel and Conversions API. They transmit to Meta information about what you do on the website, for example, visited pages, adding to cart, and orders. We use them to measure ads and show them to the right people.
• Google: on the website, we use Google tag (Google Analytics and Google and YouTube ad measurement), which transmits similar information to Google.

Cookies. The website uses necessary cookies for the cart and account to work. Statistics and marketing cookies (including those from Meta and Google above) are used only with your consent. You can give or withdraw your consent at any time from the cookie banner ("Manage preferences"), or you can delete cookies from your browser.

Customer lists for ads. If you have purchased from us, we can transmit your email address and phone number to Meta and Google in encrypted form, so we can show you NOAH ads or, conversely, stop showing them to you. We do this based on our legitimate interest in keeping our customers informed. You can object at any time, without any explanation, by writing to contact@noah-watch.com, and we will remove you from these lists.

Some of these suppliers may process data outside the European Union, with the guarantees required by the GDPR (for example, standard contractual clauses).
